The EBA movement started in the late 1980s and, by the early 1990s as with the rise of buyer agency in general in U.S. states, firms came into being and a national trade association, the National Association of Exclusive Buyer Agents (NAEBA), was formed. According to NAEBA, EBA firms offer service to buyers in almost all 50 states. [1]

Real estate firms in the United States can represent both buyers and sellers in the same transaction, and when representing both, derive profit from both the seller and buyer side of the transaction. While some states have, at the insistence of Realtor trade groups, created various forms of dual agency to allow one company and in some cases a single agent to represent both sides, other states have continued to hold such practices as illegal. In the opinion of EBAs, it is not possible to faithfully represent clients with opposing interests simultaneously.

The service structure for EBA real estate practitioners is to show buyers all possible listings from other cooperating brokers as well as all other sources, such as for sale by owners. Then, they assist the buyer with evaluation and negotiation and advocate in the buyer's best interests without restriction.

EBA firms amount to less than 1/2 of 1 percent of all real estate firms in the US.[citation needed] The EBA business model of unconflicted buyer representation eliminates the possibility of the buyer being confronted with the conflicts of interest which may be associated with the Dual, Limited or Designated Agency business models.

As an EBA Client, you can expect responsiveness based on a written contract with your Real Estate Agent. This agreement establishes that your agent is legally accountable to you, not the seller, and it requires that he/she not divulge confidential information to the seller or the seller's agent.

This ensures that your Real Estate Agent represents your best interests, and only your interests, in buying a home. This agreement further establishes that your Buyer’s Agent does not represent the interests of any seller, real estate agency, mortgage lender, insurance company, or other vendor.

As an EBA member, your Real Estate Agent will deliver you the utmost professional assistance including:

  • Search out properties on the market, including "For Sale By Owner" properties not included in the MLS;
  • Evaluate your loan package to identify a favorable loan and rate;
  • Develop a preliminary evaluation of a property (including both pros and cons) and provide an explanation of comparative property values in the area;
  • Properly advise you on price and other advantageous negotiating options and prepare a purchase offer,
  • Deliver any purchase offer promptly to the seller or the seller's agent,
  • Negotiate only on your behalf;
  • Arrange inspections, warranties, and any certifications that might affect the value of the property;
  • Accompany you on a final walk-through of the property before closing;
  • Attend the closing and provide assistance to you and your attorney at the closing.

By working with a Real Estate Broker who holds a valued membership in NAEBA, you, the buyer, can expect your home search, purchase and closing to be as anxiety-free and streamlined as is humanly possible.
